USER AGREEMENT

Welcome to the WSETonlineclassroom.com (the "Site") provided by the Wine & Spirit Education Trust (“WSET"). Access to and use of the Site is governed by the User Agreement ("Agreement") set forth below, any applicable laws, statutes, ordinances and regulations, as well as any operating rules or policies that might be published from time to time on the Site. This Site is an educational web site available to those of legal drinking age.

Before you begin using the Site, WSET requires you read and accept the following Agreement, Refund Policy and Personal Data Policy. BY CLICKING ON THE BUTTON MARKED "I AGREE TO THE TERMS AND CONDITIONS OF THE WSETONLINECLASSROOM.COM USER AGREEMENT, REFUND AND PERSONAL DATA POLICY" ON THE SITE, YOU ACCEPT AND AGREE TO THIS AGREEMENT AS APPLIED TO YOUR USE OF THE SITE. If you do not agree to this, you may not access or otherwise use the Site.

Changes to this Agreement
WSET may, in its sole discretion, change, add or remove any portion of this Agreement, at any time. Your continued use of the Site after such changes are posted will constitute your agreement to such changes.

Modifications to Site
WSET reserves the right, for any reason, in its sole discretion, to terminate, change or suspend any aspect of the Site, including, but not limited to, content, features or hours of availability. WSET may impose limits on certain features of the Site or restrict your access to part or the entire Site without notice or penalty.

Fees and Payments
The fees and charges for each course ("Course") you register for will be billed automatically to your credit card at the time you register for that Course. You agree to pay or have paid all fees and charges incurred in connection with your user name or password (including any applicable taxes) at the rates in effect when the charges were incurred.

Refunds
Refunds will be governed by the Refund Policy. No refund of payments will be made to the Customer upon termination of the Agreement by either the Company or the Customer.

User Information
In the course of your use of the Site, you will provide certain information to WSET (such information collectively is referred to as "User Information"). WSETs use of any User Information you provide shall be governed by the Personal Data Policy.

User Conduct
You are solely responsible for your conduct while accessing the Site. You warrant and agree that:

(1) you are at least the minimum legal age to consume or purchase alcohol

(2) your use of the Site, username and password will only be for your own personal use and you will not provide your username and/or password to any other person to access the site

Restrictions on Use of Materials
Unless otherwise noted, all materials, including, but not limited to all text, editorial content, course materials, images, graphics, logos, illustrations, photographs, video, audio, and other materials, as well as the designs, icons, layout, "look and feel," and all other graphical elements, and all code and software of this Website and all copyrights, trademarks, service marks, trade names, patents and other intellectual property rights in any of the foregoing (collectively, the “Materials”) are the sole and exclusive property of WSET (or affiliates, or designees) or its third-party licensors, and are protected by U.K laws and international treaties. By accepting these terms, you do not become the owner of the Materials, but are entitled to use them according to these Terms and Conditions and subject to all additional intellectual property notices, information or restrictions accessed through this web site.

Except as permitted under the “Permitted Uses and Prohibitions” Section,below, no Materials may be copied, reproduced, sold, rented, modified, republished, uploaded, downloaded, posted, transmitted, displayed, distributed, or otherwise used in anyway; provided however, that where specifically permitted, subject to the provisions of any applicable Legal Notice (described below), you may, download and print a single copy of portions of Materials on a single computer for your own personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices contained in the original Material on any copy you make

Permitted Uses and Prohibitions

Termination
This Agreement constitutes a binding agreement between you and WSET until terminated by you and WSET, which WSET may do at any time, without notice, in WSET sole discretion. If you become dissatisfied with the Site, in any way, your sole recourse is to immediately discontinue use of the Site.

Notices and Disclosures
Except as explicitly stated otherwise, any notices shall be given by e-mail to WSET at CONTACT US to you at the e-mail address you provided to WSET. Notice shall be deemed given 24 hours after e-mail is sent, unless the sending party is notified that the e-mail address is invalid.
